Waiver & Release of Liability for adults & minors
Aviantours has been in business for the last 6 years and has an perfect safety record. We make your well-being our primary concern. The following waiver of liability is necessary for us to maintain our insurance and therefore we could not have this sort of business in this day and age without it. Before participation in our tours, the parent /guardian of the child listed on the Aviantours consent document has declared their intention for the child to participate in the tour by Aviantours. Each participant's parent / guardian understands that this Waiver and Assumption of Risk covers and applies to all activities as part of the tour described above including adults accompanying the child. The participant's parent / guardian understands and agrees that Aviantours may not be held liable or responsible in any way for any injury, death, or theft other damage to their person or his/her family, heirs or assigns that may occur as a result of participating in these activities or as a result of the negligence of any party, whether the negligence is passive or active. Aviantours acts as an agent only during the duration of the tour and assumes no responsibility for any damage, injury, loss, accident, theft, delay or irregularity which may be caused by defects in the transport vehicle or any other cause, nor for the action or inaction of any person involved in transporting the passenger, his/her property or in making their travel arrangements.
The participant's parent / guardian, acknowledges and assumes all risks associated with any and all tour activities, including any injury or damage to self or property or death that may occur, including all the associated risks, whether foreseen or unforeseen, including, but not restricted to; all causes for death, injury, loss, damage to person or property in connection with any service resulting directly from: acts of god, detention, annoyance, delays, expenses arising from quarantine, strikes, thefts, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, terrorism, government restrictions or regulations and discrepancies or changes in transit or hotel/lodge services These activities may include various forms of travel or travel by foot.
The participant's parent / guardian understands that at times, the may involve physically-demanding activities that may cause physical strain that is not necessarily experienced in everyday situations, and in case of injury, including injuries resulting from a heart attack, panic, hyperventilation, altitude sickness or other injuries caused by physical exertion. The participant's parent / guardian will assume the risk of such injuries, even death, and will not hold Aviantours responsible. The participant's parent / guardian understands that wildlife trips naturally involve certain risks, including contact with potentially dangerous wildlife, possible transmission of diseases such as COVID19 and others, reduced social distancing or travel over uneven, rugged terrain. The participant's parent / guardian, also understands that travelling over uneven, rugged terrain, may entail some inherent difficulties and risks, including longer travel time to a hospital in an emergency. Aviantours reserves the right to terminate a tour at any time if a child does not behave in an ethical and responsible manner or brings into disrepute the integrity and professionalism of the establishment, and in such event, the participant's parent / guardian, will agree to forfeit any tour fees in full, without possibility of claim.
Aviantours cannot accept responsibility for losses or additional expenses due to illness, bad weather, strikes, war, quarantine transmission of any disease as a result of reduce social distancing or other causes, nor for delay or other services. Such losses or expenses will be borne by the the participant's parent / guardian, as the cost of the tour only covers travel arrangements during the set time. The The participant's parent / guardian also acknowledges that personal luggage and belongings are his/her responsibility alone. Aviantours is not responsible for the procurement of insurance for the participant. The participant's parent / guardian acknowledges that, prior to beginning any tour with Aviantours, he or she (if necessary) will have obtained appropriate insurance that is valid for the entire duration of the tour and country. Aviantours will not entertain any applications for compensation or refund, either part or full, in the event of bad weather or lack of nature, as a lot of wildlife, birds & photos can still be seen/taken. In the case of photography, it challenges the photographer to overcome these conditions. Aviantours will nevertheless endeavour to try their utmost to work around this eventuality. The participant's parent / guardian are advised to seek their own travel insurance (if necessary) prior to touring with us. Aviantours will not be liable for any death, injury, illness or theft of any item from persons touring with Aviantours. When you participate in our tours you automatically agree to these conditions.
Aviantours reserves the right to change tour dates / times for any tour than those mentioned on the website or in the itinerary. If this is necessary, the participant's parent / guardian will be notified prior to commencement of the tour. The participant's parent / guardian waives Aviantours of any responsibility with respect to any action or suit brought by him/her, his/her family, his/her estate, his/her heirs or assigns, arising out of participation in these activities, including claims arising during the activities or after travel. The participant's parent / guardian acknowledges and agrees that this Release shall be effective and valid for all activities with Aviantours from the initial implementation date of this Release. The participant's parent / guardian understands and agrees that this Release is divisible, and any portion thereof that violates any laws or regulations of any governmental agency having jurisdiction, will affect only the portion deemed invalid or inoperative, and the remaining portions of this Release shall retain full force and effect. The participant's parent / guardian, declares that they are of age and has the legal authority to sign such liability release before commencemt, or has obtained the written consent of any other person(s). The participant's parent / guardian has been fully informed of the contents of this disclaimer and assumption of risk, having read it before signing on his/her behalf and on the behalf of his/her estate and understands the terms herein are contractual and, and signed it willingly. Do not alter these conditions in anyway, as doing so will prevent participation in our tour.
